The list of compliance requirements that employers are challenged with is extensive. One of the basic regulations in this long list of requirements is in regards to labor law posters and how businesses must deal with them. Federal and state governments require businesses to display certain labor law posters in the workplace. Let’s take a look at these labor law poster requirements.
Who is required to display labor law posters?
Many of the regulations enforced by the U.S. Department of Labor (DOL) require that posters be displayed in the workplace in a location that is visible to employees. Posting requirements vary by statute. This means that not all employers are covered by each of the regulations and thus may not be required to post a notice that is not applicable to them. For example, some small businesses may not be covered by the Family and Medical Leave Act (FMLA) and would not be subject to the Act’s posting requirements.
What are the federal posters that need to be displayed?
The following are the labor law posters that are required, at the federal level, to be displayed along with which businesses are required to abide by those regulations.
Employee Rights Under the Fair Labor Standards Act (FLSA)
Every employer with an employee subject to the Fair Labor Standards Act’s minimum wage provisions must post, and keep posted, a notice explaining this regulation. This poster states that employees must be paid at least federal minimum wage unless State minimum wage is greater.
Job Safety and Health: It’s the Law (OSHA)
The OSHA poster informs workers of their rights under the Occupational Safety and Health Act. All covered employers are required to display the poster in their workplace.
Employee Rights and Responsibilities Under the Family and Medical Leave Act (FMLA)
Public agencies, public and private elementary and secondary schools, and private sector employers with 50 or more employees in 20 or more work weeks are required to display the FMLA poster. This notice provides employees their entitlements to paid leave, as well as how to request leave.
Equal Employment Opportunity is the Law (EEO)
This poster is intended to protect employees from certain types of discrimination when it comes to employment opportunities. Every employer covered by the nondiscrimination and EEO laws is required to display the poster.
Employee Polygraph Protection Act (EPPA)
Those who must display this poster include any employer engaged in commerce or in the production of goods for commerce. This requirement does not apply to federal, state and local governments. According to this poster, employers are generally prohibited from requiring or requesting any employee or job applicant to take a lie detector test or from disciplinary action for refusing to take a lie detector test.
Your Rights Under USERRA (USERRA)
Employers are required to provide this notice to persons entitled to the rights and benefits under the Uniformed Services Employment and Reemployment Rights Act.
What posters do the State of Maine require?
In addition to the federal requirements, each state has their own additional requirements. Be sure to check with your state’s requirements to stay compliant. Below are the labor law poster requirements that all businesses in Maine must adhere to.
Workers’ Compensation
This poster is required for all businesses in Maine with at least one employee. This notice is to employees regarding the requirement of workers’ compensation in the workplace.
